Seller claimed fork to be brand new, is it new though?

Definitely not new but still looks useable. I'd ask for $20 back or you will file a "item significantly not as described" claim

If it's all cosmetic and it really doesn't bother you, ask for $10 off saying that the seller's pics didn't fully describe the condition of the forks. I bet that the seller would rather refund you $10 than deal with a return. Would you be fine if you got it for $40 instead?

I just filed a claim requesting $10 back. I rather get something back then nothing. I will keep everyone updated.

It sounds like seller ended early and sold it to him off site to avoid ebay fees in which case buyer has no protection

Looking at the additional photos, I'd say that fork has had a brake installed.
also looks like a wheel has been mounted in the dropouts, no plastic spacer scuffed it like that. I would send it back, wouldn't trust a carbon fork from a scammer. BTW, is the steerer carbon or aluminum?

That fork has been used. Not just installed and not ridden. Look at the Imgur pics, the brake mount is coated in road grime.

I would have requested a full refund...because, liar.

Carbon steerer. It's a solid fork. I just don't like the fact that he wasn't honest at all.

Frankly, the marks on the dropouts, the scuffs above the logo and the pockmark in the 'C' visible in the first ebay photo would have made me wary of the "new" claim.

As far as how to move forward at this point... I'd probably return it and give the guy a ding on his feedback score, 'cause his little "what is 'new'?" dance is a bunch of BS. That or I'd want a refund equal to the cost of having a shop inspect it.

Update: "I looked at my original picture and you can see the scratch in the clear coat on the left blade. Dust is dust,not dirt. there has never been an axle in the drop out. there has never been a crown race on the crown. it has never been cut, therefore it is new. $10 off.... no way . You are trying to scam me. Take it to a shop in your area, have them call me with what they think. They will say you got a great deal, and to stop worrying about it. Aggressive, manipulative seller. Does his tone sound like someone who was trying to help YOU out. I don't think so. You don't need that crap. Send it back for the $50 refund and put in a claim for the shipping both ways. "Substantially not as described."

Theres also spacers and stem lines on the steerer but I didn't take pictures of it.

Sounds like OP and seller have different definitions of "new". I will agree it is definitely not in "NIB" condition. It's arguable whether it fits a "like-new" definition; the pictures are more consistent with "new, take-off". It's the OP's call on what OP wants to do; sounds like the seller is at least willing to take a refund, so I wouldn't necessarily ding his feedback for this. $50 for a fork is a good price, but I understand the concerns about whether it'd be safe to ride. OP has to make that decision. If it were me, I'd probably keep the fork and move on.
