Simeoni versus Lance Armstrong....

The last Rebel?

A date has been set for the hearing of Filippo Simeoni’s lawsuit against 7 time Tour winner Lance Armstrong.

December 14th at the Gup del Tribunale di Latina, will finally see Simeoni’s case against Armstrong.

Simeoni was the main witness in the trial of Michele Ferrari who was found guilty of sporting fraud and malpractice.

Although Lance Armstrong said that if Ferrari were found guilty he would cease working with him, both on Italian TV and in the French Newspaper Le Monde in the weeks before the Tour de France 2003 he strongly backed his coach.

In response to this, Filippo Simeoni, lodged a charge of defamation against Lance Armstrong with courts in Paris and Italy. He alleges the American called him an "absolute liar" in an interview with the Le Monde newspaper and on Italian TV.

Simeoni gave evidence in the doping trial and was praised by the judge for his sincerity. Following Armstrongs statements he said -"We have to respond in court," he said. He is seeking €100,000 (£71,000) in damages.

"It's not a question of money. If I'm awarded money, I'll give it to charity," said Simeoni .

Ferrai’s Appeal

The appeal of Michele Ferrari was postponed on Tuesday this week.

Ferrari had appealed a 12-month suspended jail sentence handed to him by a Bologna court last year for sports fraud and malpractice. He was acquitted of the most severe charge of distributing health-threatening doping products.

Judges cited technicalities for the postponement. A new date was not immediately decided.

Armstrong, who has defended his ties to Ferrari, has not been mentioned in the trial.

Sure looks like a civil suit to me. Can somebody tell me how much money that is in U.S. dollars?

Interesting that Ferrari was acquited of the doping charge. But what the hell is "sports fraud and malpractice." This is getting muddier as I look into it.

the lawsuit (and its related developments) are not the same as the news of the indictment. this lawsuit has been pending for a long, long time and the story above says his suit goes to trial yesterday. the criminal trial is scheduled for March 7, 2006.

OK. I don't like to use all caps, but THERE ARE TWO SEPARATE LEGAL PROCEEDINGS HERE. A LAWSUIT FILED BY SIMEONI, IN WHICH THE TRIAL WAS SCHEDULED TO START YESTERDAY, AND A CRIMINAL INDICTMENT THAT SAYS LANCE IS TO STAND TRIAL IN MARCH, 2006.

From the ProCycling quote above. There are two actions pending, yes. One in France and one in Italy. Simeonia initiate both. Which one is criminal and why?

that makes three altogether. two civil suits filed by Simeoni in France and Italy (apparently promising to give proceeds to charity), the Italian one was scheduled for trial this month. the one in Paris, according to Euro, was delayed or something, and today, Lance Armstrong was "indicted" by the Italians and is scheduled to stand trial in March, 2006.

there is only one, very specific and very clear meaning of indicted and it has nothing to do with a civil lawsuit.

I wasn't all that interested in this news, but suddenly I am obsessed. I think Lance is gonna take it on the chin here.

Me too. I agree that "indicted" has specific criminal meaning, but was thinking perhaps the Italian civil court system requires some type of certificaton before a civil suit can proceed, hence an "indictment."

I think Lance might have a defense. He called Simeoni a liar. A liar about what is the key issue. Ferrari apparently beat the doping rap, so Lance can say his liar allegation related to Simeoni's testimony about Ferrari's doping advice.

OTOH, the standard of proof is lower in a civil trial, so Simeoni may well prove Ferrari to be a doper in the civil proceeding, thereby overcoming Lance's defense. Also, all Simeoni needs is another cyclist to testify against Ferrari.

These could be an interesting but difficult trials, especially for Lance. He is gonna have to prove that Ferrari, his long time doctor, is not a doper. Not just with respect to Lance, but all of Ferrari's clients.

Surely, Lance is gonna wish he didn't shoot his mouth off. I hope he wins, but it don't look good. I mean, how in the hell is Lance gonna find a disinterested witness who will testify that Ferrari is NOT a doper. There are no credible witnesses in Lance's favor.

It made no sense from a racing perspective...only as a personal vendetta - so why would he do it and why would you cheer him on, from the perspective of a Lance supporter? How was he protecting the peloton's interest, as he put it? Serious question.

Didn't Ferrari come up with the barely detectable method of EPO microdosing?

It's also true, as a previous poster mentioned, that the peloton never gets upset at those caught doping but rather with those who imply or accuse others of doping. Telling logic that.

Serious answer. It doesn't matter why he did what he did, he did it and I liked it. Maybe just to crush the "little guys spirit" as you would see it, or just a head game to crush everyone in the pelotons spirit and show them all who is the BOSS. It's to bad it hurts your fragile sense of fair play.
