Spam from Performance - not the sale notices

I use a unique email address for every company I deal with. It's done with some software I've written, eventually I'll get it to a stage where other people can use it. But for now it allows me to see who has sold me out when I get spam.

Performance has been really good. The only emails I get at my Performance email address are order confirmations and sale advertisements every couple of hours. Until Monday the 10th anyway. That's when I received an email to my Performance email address from BikeNews@Rodale.com advertising Bicycling Magazine's Personal Trainer program. Apparently they have sold my email address to Bicycling Magazine. Since then I've received spam at this address selling "s0ftware" and the secret that will change my sexual life instantly. 7 spam emails total.

This is in a clear violation of their Privacy Policy:

I've also received 5 spam emails at my Bicycling Magazine address. Oddly enough they are not the same emails, and I didn't get the pitch for the personal trainer.

Yes, yes, I know. If I didn't shop at Performance or order that crappy magazine I wouldn't have this problem. It's not really a problem, it's actually a great test for my software. But I thought you guys might want to know what Performance does with your email address.

I've emailed customer service asking for an explanation.

I use Gmail which pretty much kills 99.99% of all spam anyway.

There are other ways that spammers get information. I have a google email account that I have never used for ANYTHING, and have never even sent an email from, nor shared with anyone, and it is loaded with spam...

Right, but unless you are in the market for a Swedish sausage stretcher, then I doubt it is spam that is marketed toward your specific interests like the posters situation seems to be.

Sounds to me like they make all kinds of reservations to allow themselves to spread your email and home address.

Yes, really.

Performance Inc. does not rent, trade or sell your personal data to third parties but retains the right to do so in the future. Please be aware we may share customer information with the subsidiaries Performance, Inc.

Performance can share my email address with Performance.com, the Performance stores, Nashbar.com, etc. But not with third party companies not owned by Performance Inc.

It might be because you were given a free subscription to Bicycling with a Team Performance membership. So, now that you are a customer of Bicycling, they can send you emails. Not really spam from Nigeria, but annoying nonetheless. I'd ignore this one...

2 important points to read:

"We may share your mailing address with reputable companies we feel you may have an interest."

Everyone shares - even if they say they don'y. Just like bulk mail. Until some sort of regulatory board exists governing email - its the wild west.

I moved cross country to CA back in '96. When I changed my drivers license to CA my middle name was entered as Pester instead of Peter. After about three weeks I started getting mail and phone sales contacts with Pester as my middle name.

They took me for hundreds of $$ for an emissions sticker on a eight month old vehicle but the junk mail and phone calls p'd me off more.
