Dad got into accident, bike totaled, what to do?

Light was green so he went ahead, but some lady making a right turn did not see him and went for it, hit him and totally damaged my frame, tires and computer. He got her license plates, name and a witness who drove him to work after. As normal she was really scared, even more scared that we report her to the police and let the insurance handle it. She said she would pay anything as long as we don't call the insurance

What do I do? do I quote her and ask her to pay me, if she does not call her insurance?

How did you guys handle it?

It's a judgement call. I've done both in car accidents and the only time I didn't deal with insurance was because the guy worked with a neighbor at a church. Figured he was good for the money.

You're not a bad person if you want to deal with it through insurance though. That's why she pays for it.

Report it to the police and contact her insurance. It's not just your bike, it's your Dad's health. He was hit by a car, all kinds of things could pop up in the next few weeks. He should go and get checked out by a Doctor and that should be paid for by her insurance, as well. You may want to be a nice guy, but you need to protect yourself and your dad.

Police 100%. Did she give you her insurance details? Sounds dodgy not wanting to go through insurance - that is what it is for. Also take the advice from other threads - don't sign any insurance thing saying you are ok before your dad gets completely checked out etc.

She doesn't have to pay for anything if her insurance does it.

Sounds very suspicious... but you need to report it to the police.

Dad said she was worried that her insurance would go up, so that's why she said she would pay for damages. Witness told my dad just to call her insurance and let them handle it

Apparently there is a quote limit... but you get the point.

My .02 is that there needs to be some sort of documentation of this, so if she is involved in a lot of accidents there is a history. It sucks, but she has to deal with her insurance going up.

Always report accidents to the police at the time of the accident. The insurance companies want you to do this.

Part of the problem with not dealing with this the right way, is that the person can change their minds the next day.

Don't be stupid. Police, yes. Leaving the scene is a big deal. Who knows who else this driver has hurt? Insurance, yes. Back/Neck other injuries may not present immediately. You NEED to have a record of events in case any sort of medical costs come from this. NEEEEED.

I second reporting it, you never know what kind of complications could affect your Dad at a later date. Is he ok?

It's unfortunate that we live the this day and age when we need to be so carful.
It's not your fault that she did not look well enough to be safe, and as a result there are damages, some of which are obvious and some may not. I would report it to the police for sure. Let her pay for the new bike if she wants, but at least there is a police report that you have in your hand if the need arrises. Good luck

Are you sure she even had insurance?

If she didn't, then offering to pay for everything was her hope of avoiding getting arrested.

She sounds sketchy. I would have called the police and made a report right there. And definitely call the insurance.

If you're ever in any kind of wreck you should do this. It will usually insure that you won't get screwed over. Also if you ever get in a wreck and feel pain, you should goto the hospital right after filing a report. If you wait and go the next day, their insurance may not cover it (assuming it was their fault).

I would be really cautious about people that want to leave the authorities or insurance company out of it.

Hey, here is the good news to assuage any guilt you have about reporting the accident.
As long as she pays out of HER pocket, and a claim is never paid by her insurance company, it will not affect her insurance rates.
(Now she could possibly be ticketed but if she is forth coming with the money for the damages (and a Dr visit), you can always request that the police not ticket her. They would typically honor that if her record is clear of dangerous driving)

I suspect she has no insurance. Definitely settle with the insurance company if there is one. Around here if she didn't want her rates affected she could choose to pay the insurance company whatever they paid out.

When I impacted a car, my renter's insurance really helped me out. They covered my bike, no questions asked. Mainly because I had a police report (and all sorts of other paperwork due to the hospital visit). They told me I could file for medical under my car insurance, since a car was involved in the accident. (I didn't). Something like this, your company is not going to care (if you have the accident documented). They will get re-embursed by the other person's company. If she does not have insurance, you are still covered.

IF you have uninsured motorist coverage, which is not required in all States.
