So patentcad, you'd buy a 2008 car off the lot and pay the 2010 sticker price because the 2008 was still new? I don't think most people would. It was advertised at a 2010 frame so that's really what I thought I would be getting.


Here's the sticker. When I questioned the seller she said yeah, it was manufactured in 2008 but they haven't changed the model and the 2010 is just the same. What if I built it up and decided to sell it in six months. Would I sell it as a 2008 bike or a 2010 bike. Trek says it's a 2008.

I have appealed and I am disputing the charge, but I just wanted to warn buyers that e-Bay's buyer protection plan is a little shady. Just try to contact them! Five days later - after waiting for their 7 day mandatory dispute period - I'm told they side with the seller. Crazy.

That $uck$ sorry to hear that, i guess if trek says it is a 2008 frame then i guess if you sell it you would have to state that it is a 2008. Is there any other stamping on the frame which states a year? Looks like if you remove that label how would anyone be able to deny you that it is not a 2010 if you try to sell it.

I would try to negotiate some compensation with the seller. You got a beautiful frame that is new, at what looks like a great price. Yes, he misrepresented it, but get some money from him and ride the frame. Once it is built up, you won't even think about what year it is.

the fact that the seller escalated the dispute meant he is not amendable to any sort of compromise or mediation. you have a copy of the auction mentioning '2010 frame' and proof that you got a 2008 frame. it's a slam dunk. if you are not really happy and wont be content with what you got, then the dispute it with your credit card.

i hope everything works out the way you want it to.

i would be very upset as well if I was you. Just a thought though, if it's the same frame as a 2010 and it's brand new isn't it basically a wash. It would be the exact same frame but with a different build date. If the frame is new what's the real difference ?

but as I said it's your money and it's the principle of the situation is your purchased something and received something else. Just trying to ease the blow in case things dont go your way.

Nope that sticker is not a mold, frame, or copyright date.

Be Patient and appeal, but only appeal through Paypal or ebay, not both at the same time. Filing a claim with both at the same time will cause your claim to be closed. Save the credit card claim for last if you don't get satisfaction through ebay or Paypal.

If you paid on Paypal it's exceedingly simple. File a "Not as described" complaint and indicate you wish to return the item for a refund. After you win (you will) they will refund a portion of the price paid and stipulate that the remainder will be refunded when you ship the frame back. Don't ship the frame back.

That will be the end of it.

I was trying to point out that the sticker that is under the bb is joke, they should have some serial number or something stamped on the frame to assure anyone what year it really is. Having said that unfortunately as mentioned the only solution to the problem is to file a claim to paypal as "NOT AS DESCRIBED" it is unfortunate that there are pic's of every angle you can thing of but the seller neglected to take a pic of the bottom of the frame. Hope you are able to settle this issue in your favor,GL!

As others have stated, I would start the process thru PayPal. The item purchased was mis-represented. Hope it works out for you, but I must say, that is a pretty nice frame set, love the paint scheme.

Wow that frame is almost a 2007, you got ripped. At least you got a frame, I know of people that got used stuff avertised as new. I think ebay is a risk as any auction is. If you want a new frame and to be sure pay out the nose and buy it from the LBS or order from some place online. Just remember the only true free people are the rich.

Paypal/Ebay disputes as I understand it:

-Paypal disputes have been done away with for ebay auctions, now it's done under ebay seller protection - https://pages.ebay.com/coverage/index.html

-Disputing it with your credit card company is only possible if it was paid for by credit card (why would they care otherwise?).
I believe the default prioritization of payment methods is:
#1) any paypal balance in your account
#2) pulling straight from your bank account
#3) if not enough funds exist in your bank account, your credit card.

Paypal likely hates CC payments because they'll get hit with fees (a taste of their own medicine) and the consumer has a better ability to dispute it with a party that isn't both the auction house and payment service. I'm baffled that they didn't remove the sticker prior to shipping.

ebay - ouch

It would seem that the seller could easily have accepted the frame back, repost with the new info and sell it with accurate information. Win-win for everyone.

Not trying to threadjack but I also had a poor ebay experience this week. I thought I had purchased a nice Madone 6.9 from a seller. Price was fair and the pictures/description seemed to be consistent with that year/model. Things started to go a bit off course when the seller asked if we could bypass paypal. Sounded odd but I offered to call him if he'd provide a phone number. When he suggested I provide my phone number and he'd call me I replied with "you know, I have a friend in your city. Why don't we arrange for him to meet you at a LBS and complete the transaction there?". 15 minutes later I get a message from ebay that the seller's account was compromised and that I shouldn't reply back to any message from this person. Weirder...the record of my winning purchase was gone. Even weirder than that...the sellers feedback changed too and didn't reflect the info I had used to gauge if this was a good guy/bad guy. When I called ebay customer care to ask if this was typical (I'm not a frequent ebay user), the reply I received was that since no money had exchanged hands I should probably just look again for another item I'd like to buy. Felt like I was watching a scene from The Naked Gun as Frank Drebin shouted "nothing to see here".

Buyer beware on ebay. Wish there was a better way to get the benefit of so many extra sellers without the risk of losing $$ or misrepresented items.

justabikegirl, if you care to divulge the serial number, I can probably establish the actual model year. For what it's worth, I work at a Trek dealership, and would still have serious trouble pinning down the exact model year of a US-made 5-series Project 1 (which both the '08 and '10 were). Without running the serial number, there's not a single difference I can think of to tell them apart visually, I'd have to bust out calipers and measure the lower headset-bearing socket. The 6-series are easier, having had some easy-to-spot design changes.

BTW the serial number will be on a sticker behind the BB shell where the chainstays join it.

In the event you decide to keep it, post what crankset you plan to use and I'll look up the appropriate bottom-bracket part number, if you like. Did it come with the headset? Oh, and did it come with the rear brake-cable stop, which would be a black aluminum jobbie similar to the front one?

This kind of just happened at out shop.

We ordered a "2010" full suspension mountain bike and we received a bike in a box labeled "2008".
Sure, they were on sale but our rep said they were 2010 models. Upon further research it turns out that the bike hasn't changed specs or color in two years. Its not a bike we normally stock so we kind of got fooled. In the end, the public is kind of getting fooled, but the price is right. The bike is about 40% off retail and is a steal.

In the future we're double and triple checking specs on bikes we normally don't order. Yeah, its our bad but the rep also wasn't too forth coming with the info.

I'm puzzled - why would nixonvw go through the trouble of selling the frame as a 2010, but not bother to peel that sticker off? Had he done that, you probably would never have known.

I took a look at his offerings - it looks like he lives near a trek dealer and steals little things one at a time to list on e-bay.

Or they give him/her huge discounts to take NOS off their hands and don't care what he/she does with it after it leaves their store.

Please keep us apprised of your findings. When people do things like "bait and switch" you have to (sadly) hold them accountable. Ebay/Paypal should be partners in really holding sellers & buyers accountable. At the end of the day - I hope you are able to get what you deserve - a 2010 bicycle. Not something manufactured 2 years prior.
