Got run over..how's this work
On a training ride today and a guy going the same direction turned right in front of me. It ended poorly for me and my bike. I'm fine but my bike isn't...It was a gorgeous Wilier Cento Uno in colorway never imported to NA. Campy, 3T, Powertap..oh my baby!!!!
The rear triangle is cracked in three places. I was drug for 10feet so there is some grindage. I have the original receipt sans wheels, I don't have a receipt for my kit, iphone, helmet, powertap (although I think thats going to be fine) but the wheels will need to be trued. will I be fully compensated? I'm scared I'm going to get screwed over. I suppose I could get my homeowners insurance involved somehow? At least you're ok. Don't know if the guy insurance will pay though, I've never been run over like this...

His insurance should pay, when I was hit I just got a estimate from the bike shop for everything. Had a check in a couple of days.

That's an awesome bike. Glad you are OK. I think you'll get taken care of by the driver's insurance.

If the cops write it up as his fault, his car insurance should pay for everything. When I got hit, I got full replacement cost for a new bike, all clothes (that were cut off me at the hospital) and all other equipment that was damaged. I didn't have receipts, I think I just listed what it all was and what I paid for it. I took the bike to a shop and they wrote up a repair bill that was more than the cost of a new replacement, so they just gave me replacement value. My bike was totally ordinary, though. Don't panic, it shouldn't take too long to sort out, don't get your insurance involved unless his won't pay. |
His insurance should pay. Bring the bike by your shop for an estimate. When I got hit, they paid for full replacement of my 2 year old bike. I sent links to the adjust of the closest stuff I could find to my damaged clothes online.

Glad you are okay, but damn that sounds like an amazing bike. For it to get destroyed in such a way..what a shame.

Definitely see a doctor before you talk to the driver's insurance company. They should let you file a supplementary medical claim at a later time, but easier to take care of everything at once. You did get the driver's insurance information, right?
Receipts shouldn't be too important if you can show them the damaged equipment. If you don't file any medical claims, they may be more generous with their equipment damage claim (paying replacement value without depreciation). Don't let that deter you if you have legitimate medical issues, of course. |
Do not let the adjuster steamroll you. Do not sign a release unless you are absolutely satisfied with what they've decided to pay you.
Remember, you might like the adjuster personally, but he/she is not working for you. |
IMO not calling the cops to the scene and getting the situation documented right then and there was a BIG mistake. He said She said at this point. Hopefully the driver is cooperative, but if there is no evidence that clearly indicates that car and that driver did the damage and it was the drivers fault the insurance company will probably not be very willing to do anything.
What did CHP say? Did the driver get a citation? |
Be very aggressive. The insurance company will do everything in their power to save their money. A friend of mine got hooked and had his bike destroyed, plus he had his hip wrecked. The insurance company wormed their way out of paying for a lot of stuff. Document everything. Always talk to the cops.

When the adjuster provides their first settlement offer, tell them, before signing it, you want to review it with your attorney (whether you actually have one or not).

I am aware that the adjuster is interested in saving as much money as possible and that this is essentially a negotiation. I filed a chp report later that day and have had a recorded conversation of the events with the adjuster. So far, it seems as if they will be taking care of things. I sort of wish I didn't go to urgent care, because that might confuse things between my health insurance and his insurance paying anything medical related.
As far as detail about the accident..I was traveling east on a 2 lane road when ahead of me a truck pulled out on the road from the north side intending to travel east(same direction as me). I was going at a good clip and he started going east I was even with his truck bed when he went right (south) into a driveway. I tried to brake but was on one wheel immediately. so I let off and turned right (I was at the driveway too at this point) slammed into his truck then slipped underneath it and he drug me about 10 feet. power data says I was going about 26 mph when I hit him. Had a great workout until that point.... |
Sounds pretty scary - glad you weren't (more) seriously injured.

Since you have power information, do you also have a GPS track? If so, print out the map and graphs, both for the ride as a whole and for the period immediately before and after the crash. If the adjuster tries to put any blame on you, point out that the GPS shows that you were going straight at a uniform speed up until the crash.

It will be an extra bargaining tool that you have a personal injury no matter how minor it is. The insurance will be willing to work with you a bit more, and be anxious to close the file. Don't settle until you are fully compensated for. I've been through this myself. I had to hire a lawyer, and that leech took half, but I feel I was compensated for fairly. |
