Hi, newbie here. I went to the shop before they closed looking for a first road bike, and came home with this:

I am a bit ticked that the LBS allowed a bike like this to be sold, and am concerned it is more damage than just paint.. :( Dealer said it's just a paint wound by just looking at it, and mentioned they can repaint it, but I'm concerned that the frame damage might be greater than that. Anyone know how to test the frame for damage like this? Does the damage look bad enough to warrant a claim? Can't believe a brand new bike has this already... Thanks in advance for your feedback.

That's a helluva first bike.

make them take it back if you don't want it, or negotiate a reduction in price and make 'em paint it. They should kiss your ass for a sale like that.

also, look at the wear on the teeth on the rings, that bike has been ridden.

If it happend before you bought it, like during someone else's test ride, and it was sold to you as a new bike, then they should get you another frame. If it happend while you were riding it, then you should get it painted or do whatever else makes you happy.

Either way you need a chain catcher and you need to make sure the front derailleur is adjusted correctly.

I also recomend putting some black electrical tape on the chainstay to protect it should it happen again even with the chain catcher.

Has it been ridden a lot by the looks of the wear on the teeth? ~# of miles?

Yes, I only went on a 10 min ride before buying it, and the chain never came off, so I 'm positive that it happened before on someone else's test ride, or was done during the built. I don't think they have another bike in my size. If it comes down for them to repaint it, I'm going to tell them to put on a chain catcher.

If this LBS refuses to replace it, would this warrant a claim to the manufacturer to swap the frame?

That looks like a much bigger issue than just paint to me...those white stripes appear IMO to be the carbon frame being affected. I'd demand a new frame and if they don't agree, get a refund and go somewhere else. Anyone who drops that kind of money on a bike should have the world catered to them by the LBS b/c if they can justify spending so much money on one bike, they'll probably be back for more business in the future. A good LBS is key. The one I go to is a little farther than a couple others but they treat me right, so I keep going back. It's a win win and any LBS that doesn't recognize that isn't going to last too long

Throw it down the stairs. If it bursts into flame, just lube the chain and HTFU.

Return it. It's a piece of used junk. Period.

That bike has been on some long "test" rides. Maybe a return by a previous customer.

holy cow. a LBS sells a used bike, as new, to someone who comes in for their first road bike? that's borderline criminal. when you take it back for a refund, make sure you mention how you didn't identify their shop on this forum, so as not to embarrass them. but you would, if they don't take it back and give you a new bike. but only go there if they are uncooperative. if you charged it, just leave the bike there and dispute the charge with Visa or Master Card. as an aside, you should be able to get a carbon bike for not too much more than that aluminum model, maybe with a little more newbie-friendly geometry.

From the pic it doesn't look like serious damage, but still should be repaired; and, if they sold that as new I would go back and have a talk with the owner.

That's one heck of a first ride.

for a "brand new" bike, I would never accept it in that condition. the rings on the crank look like they have been used for a little while before and the chipped paint looks terrible. I would definitely take it back and get a new one. don't let them just paint over it, cause you will still be thinking about if it is actually brand new or not. I rather have peace of mind knowing I have a brand new product that I payed for.

I agree with the above posters. I wouldn't have taken that bike. The chain rings look like they have more than just a couple test rides on them. Someone above said they think it was a return bike, I agree. If the shop won't work with you time to look for a new shop.

I have about 5000 miles on my cheap FSA Tempo crank, and the rings don't look as worn as those. I would definitely talk to the owner of the shop. But I doubt that the sales staff decided to pass that off as new on their own. Might be time for a phone call to your state's consumer protection folks.

I work in an LBS and we would never sell that as a new bike. If there was ever a failure in that area, good luck with the warranty with Cervelo. That's a very shady deal and I'd hope that you got a very very very very good deal from the shop if you were to keep it. As in more than $1000 off because that is not a new bike an any way and would certainly affect the warranty.

And that is why you need to inspect a bike thoroughly before leaving the shop...

Proving that the damage was there prior can be difficult...

BTW I would not be happy and would be looking for a full refund/replacement if it in fact came like that...

Ouch, that's pretty rough. As others mentioned, I'd be looking for a full refund or replacement. If they're not cooperative (and they might not be, it's hard to imagine this is a great shop), I'd leave them with the bike and contest the charge on my credit card. Not really an optimal solution, but it'll get you there.

The good news is that a lot of Cervelo dealers are running big end of the season sales. If you're in love with an S5 VWD (and I can see why you would be!), you can get a great deal on them. The nearest shop to me has them listed at $7K currently, multiple sizes available. Good luck, it's a beautiful bike!

1) Caveat Emptor- Let the buyer beware. It was your responsibility to check carefully BEFORE buying the bike. 2) The shop is closing? Why ever would they take it back, you bought it - your problem. 3) This is not just a paint issue, it is a structural issue,if not now then in the future. If you plan on keeping it, and it sounds like you will have to, check out those in the CF frame repair business for a learned opinion of what is necessary and good luck, fair warning for future transactions.

Not only can you see the wear on the rings but also the chain! I have rotor rings and they didn't look that wore till about 2000km. I would almost bet it was one of the shop employees ride for the summer. Did you pay full price? Did they tell you it was a used bike?

That is a carbon bike.
