Road Cycling “It is by riding a bicycle that you learn the contours of a country best, since you have to sweat up the hills and coast down them. Thus you remember them as they actually are, while in a motor car only a high hill impresses you, and you have no such accurate remembrance of country you have driven through as you gain by riding a bicycle.” -- Ernest Hemingway

+1 on recovering the can. DNA and fingerprints more than likely. Combine that with public release of the photo and these idiots will be discussing their stupidity with a judge.

First thing I thought of when I saw the culprit:

That looks like Max Headroom.

Hahaha

I bet they can't wait to take prints to apprehend the culprit for littering the road with a beer can.
After all ... that's the only thing he actually did.
Sure ... I want to believe the OP's story, but unless he's got witnesses to prove the can of beer was surely and without a doubt aimed at him intentionally, there's little a judge or anyone else can do.

You mean besides the picture? That's a very deliberate, over-hand throw, not a tossing-rubbish-out-of-the-window lob.

That's like saying, "he pointed the gun at me and missed, so no harm done". A deadly missile was aimed at the biker with the intent to hit him. Since he missed, it still is a crime. I'm not sure from the first post if this is just a single picture or a frame from video shot, but it would be nice to have something more to go on. Also, would like to hear if any progress was made with the leo's and media.

Later frames of the video also show the shower of suds as the can passes over. The is no question is was intentional.

I'm not a gun person...and I don't really want to shoot at anyone, but the thought of filling a water bottle with bleach has crossed my mind. Still, if they're flying by you at 60+ mph, not like you'd be able to hit them with it.

I've looked at pics of Bud Light and Natty Light cans, and I'm fairly certain the Natty Light hypothesis is correct. It was a mostly silver can w/ blue lettering.

Sounds good in the abstract, but the guy's prints and a DNA sample have to be on file somewhere, before there can be a match.

Then you're assuming that the cops and/or prosecutor would take the time and expense to have those forensics done in the first place. Print comparison is fairly cheap and quick. Lift the latent print off the can, then ask the computer to match. DNA, not so much.

I deal with cops day in and day out. My sense is, that at best, if you walked into the station with the can, told the story, and asked them to check it for prints, they'd humor you. At worst, they'd laugh you out of the station.

You took a (very clear) picture of what went on behind you while riding but couldn't see the tag number of the same car passing you?

Yeah, I know. I was riding without my contact lenses that day.

Didn't really take a picture - just started video mode and stuck the phone over my shoulder. That's a single frame from the vid.

I think here (NC) they are more likely to take the can and chug what's left.

Update: Received the following via email from local law enforcement.

"I received your email along with the video and still picture. I will forward the information to the patrol division officers and ATL the suspect vehicle and continue to increase our presence in the area. If you have any more information in the future please let me know.

> I take it throwing a full can of beer from a moving vehicle at someone’s head is a crime??

We possibly have more than one crime; however, we will first try to identify and locate the suspect(s). I have also made the NCSHP aware and provided them with the information you provided."

I also sent an email and the pic to the local paper this AM and am hoping to hear something back.

That's a reasonable response. Crime(s) are probably at least -- assault, open container of alcohol, and littering. Hope they find them but I wouldn't hold your breath.

The two times I've notified the local sheriff of incidents, the one time the person was found was when I had a full tag number (and it was easy to remember because it was a vanity plate). The other time I had a make, model, and color of vehicle and a partial plate but that apparently wasn't enough to narrow it down.

My understanding is that throwing a "missile" from a moving vehicle with the intent of hitting a person is a felony.

Very possible, I don't know the criminal code. They'd probably prioritize pursuing a felony over a misdemeanor.

I got a cop to detain a driver for throwing a french fry at me. It was more how close they buzzed me than the FF that was the problem. Police went to their house, read them the riot act, and I agreed not to pursue it, in exchange for an apology. I was pleasantly surprised the Police took the time to pursue it.
