I don't see why you wouldn't prevail. He may be a no-show and a default judgement could be awarded to you. Doesn't mean he will pay it though. If he doesn't, you can put a lien on him.

If the replaced fork is junk, cut the steerer just below the star nut and tap it out in the direction it went in, reuse it.
