NYC Crit Mass -- Failure to Keep Right

I just went in to traffic court for my "failure to keep right" ticket, that I got in march or april's critical mass. Like I had read on freewheels' website, the relevant statute (VTL 1234 -- which requires you to ride on the right side of the road) is not valid in NYC, because of rule number RCNY 4-02. The judge tried me last, and since the cop didn't show, I had a minute to ask him to confirm the above interpretation. He confirmed it after som hemming and hawing. Message: unless you can't spare a nice day off from work, don't plead guilty for fear of having a worse penaly after being found guilty. Your case will be dismissed. |

Way to go! I only wish everybody who gets bogus tickets could take the time to get them cleared up.

thats ****ing crazy. i got the exact same charge (well actually it was failure to keep left), and the cop did show up (with a detailed discription of what happened nonetheless), and the judge found me guilty. It was 40 bucks, so it was not that big of a deal and i was thinking of appealing it, but i got in a bike accident on the way back home, so i got other **** to worry about now.
