It'll be a sadder day still when the driver gets off with a 6 month suspended license...If it even sees the inside of a court room.
"Authorities said some of the riders also may be at fault, because they were standing in the street. Many of them also had on dark-colored clothing."
Ya' had to see that statement comming...it ALWAYS has to be the cyclist fault.

This was my favorite part "Authorities said some of the riders also may be at fault, because they were standing in the street. Many of them also had on dark-colored clothing. "
Are you serious? I mean yeah they shouldn't be sitting there in the middle of the road, but how are the f*** you gonna say its there fault when a drunk woman that's texting while driving hits them? That's BS.

You gonna eat that?
Scrod, old boy, do you suppose it would be a good policy to link to the current, open thread, when you close a duplicate thread? Certainly not necessary I realize, but it would be helpful.

Hate to see fellow riders go down. Recent hit and run here in Utah a few days ago, cyclist was killed . Someone put up a ghost bike though, one of the first I have ever seen in Utah..

No, but some of his friends are in really rough shape. He's made a few posts about their condition on his facebook.

I can't believe the first comment below the article. People make me sick. Hope everyone recovers quickly, and that drunk-texting-woman is brought to justice.

I really hope the driver is brought to justice.
There have been two recent cases of drivers hitting and critically injuring a cyclist here in Columbus. Those people have yet to be convicted last I heard.

Contrary to popular believe DUI is taken very seriously by the LA DA. And they will charge the heck out of her for this. Then they will plead it down. But she will get more than a slap on the wrist.

Bicyclists have a right to be in the road and even if they had been moving as fast as they possibly could the drunk texting dumbass still could have killed them which is why I blame her for the incident. But that doesn't change the fact that they were standing still in the damn highway assuming the car was slowing down. They might as well have been pedestrians who would have been completely at fault.

"At fault" does not mean it's entirely their fault.

In most states, if a driver is involved in an accident and that driver is legally intoxicated, that driver assumes the fault for the accident. It doesn't matter if any of the bicyclists were contributorily negligent or not.
Most state laws also allow for bycliclists to be treated as just as any other motorized vehicle on the road, with a few exceptions. Perhaps if it was dark and they were wearing ninja-black clothing and standing in the center of an unlit street the defense may have a colorable argument, but the aforementioned inebration on the part of the driver would remove that defense from the equation.
She should be charged with DUI, wreckless driving, and perhaps attempted manslaughter. Hopefully, for the sake of the critically injured cyclist, the driver is not charged with manslaughter stemming from this event.

wow. my heart goes out to them. A friend was struck on a hit and run that put him in the hospital a couple months ago. Its really hard not to feel agression towards drivers.
