It'll be a sadder day still when the driver gets off with a 6 month suspended license...If it even sees the inside of a court room.

"Authorities said some of the riders also may be at fault, because they were standing in the street. Many of them also had on dark-colored clothing."

Ya' had to see that statement comming...it ALWAYS has to be the cyclist fault.

This was my favorite part "Authorities said some of the riders also may be at fault, because they were standing in the street. Many of them also had on dark-colored clothing. "

Are you serious? I mean yeah they shouldn't be sitting there in the middle of the road, but how are the f*** you gonna say its there fault when a drunk woman that's texting while driving hits them? That's BS.

Scrod, old boy, do you suppose it would be a good policy to link to the current, open thread, when you close a duplicate thread? Certainly not necessary I realize, but it would be helpful.

I should have done that but didn't think of it because they were both on the first page.

I can't believe the first comment below the article. People make me sick. Hope everyone recovers quickly, and that drunk-texting-woman is brought to justice.

The driver may get off easily in criminal court, but if it really was the case of a drunk playing with her cell phone and plowing into a bunch of cyclists that appear to have been basically law abiding, then the driver is really screwed in civil court. Each injured cyclist should be able to sue the driver and at least some of them will win and put her in a new world of financial hurt. After that, if she can't afford her new sky-high insurance rates, she won't be driving.

I really hope the driver is brought to justice.

There have been two recent cases of drivers hitting and critically injuring a cyclist here in Columbus. Those people have yet to be convicted last I heard.

Contrary to popular believe DUI is taken very seriously by the LA DA. And they will charge the heck out of her for this. Then they will plead it down. But she will get more than a slap on the wrist.

"At fault" does not mean it's entirely their fault.

Bicyclists have a right to be in the road and even if they had been moving as fast as they possibly could the drunk texting dumbass still could have killed them which is why I blame her for the incident. But that doesn't change the fact that they were standing still in the damn highway assuming the car was slowing down. They might as well have been pedestrians who would have been completely at fault.

I think the sarcasm in my post might have been missed. Not to put too fine a point on it, but I don't care if the cyclist were all wearing stealth black ninja suits and doing track stands in the middle of the road, it's still the drunk chick's fault. Oh yeah...drunk texting??? Who freakin' does that anymore...

In most states, if a driver is involved in an accident and that driver is legally intoxicated, that driver assumes the fault for the accident. It doesn't matter if any of the bicyclists were contributorily negligent or not.

Most state laws also allow for bycliclists to be treated as just as any other motorized vehicle on the road, with a few exceptions. Perhaps if it was dark and they were wearing ninja-black clothing and standing in the center of an unlit street the defense may have a colorable argument, but the aforementioned inebration on the part of the driver would remove that defense from the equation.

She should be charged with DUI, wreckless driving, and perhaps attempted manslaughter. Hopefully, for the sake of the critically injured cyclist, the driver is not charged with manslaughter stemming from this event.
