i think we've got drunken biking laws around here, which is pretty messed up. i mean, if you actually got a ticket for it, it'd be like "come on. i'm doing the right thing. and you're punishing me. ****."

and a week or so ago i was listening to a medical marijuana debate on the radio, and people would call in and say "i've been using medicinal marijuana for my arthritis for five years...."

uh... yeah....... my joints ache, too, now that i think of it.......

I know here In ontario you can be charged with Imparied on a cycle... I've seen it happen. The cop said weither it would hold in court... depended on the judge...
But the Cyclist was taking up 3 lanes, two in one direction and one in another... the two-four under one arm did not help him keep his ballance.

You can get a DUI on a bicycle in the same way that you can get a speeding ticket on a bicycle. If you violate the rules of the road, you get busted same as any other vehicle.

However, I think most reasonable cops wouldn't ticket for that unless they suspected the person was so impaired that they were being a serious hazard to themselves or others. I think most cops know first hand the terrible outcome of drunk driving, and are willing to let a few things slide in order to prevent drunk driving from happening. But of course on your drunken bike ride you'll probably meet up with the one ass-cop in the precinct who feels differently.

The judge wouldn't just throw it out, but you could probably be in a good position to plea for a vastly reduced sentence, given the circumstances.
