The only question I have is this was such a heinous crime why didn't the DA prosecute for Premeditated Murder and allow a plea bargain?

I'm only a welder but it seems to me using a weapon (vehicle) to deliberately kill someone is (and should be) 2nd degree murder.

You'd have to look at the evidence the D.A. and the defense attorney had to work with and bargain over. Pre-meditated murder would be a high bar to hurdle unless it could have been proven the driver focused on that particular lady who got killed prior to the incident (and the others who were injured). For the little information given in that news story it seems like murder & attempted murder convictions with a 16 year prison sentence were good results for the D.A.'s office in plea bargaining process.

If the article is true, looks like this was an intentional and deliberate act(s). The perpetrator will likely be out sooner than 16 years the way CA works. Seems to me to be a light sentence for intentionally taking a life.

Thanks for sharing. I wasn't even aware of this particular incident. I'm not an attorney and I can't say I know the law that well, but I would have expected the sentence to be a little more than 16 years.

And yet 16 years is so much more than most people get after killing a cyclist. (assuming she's in jail for anywhere near 16 years might be wishful thinking)
