I love it! Everyone wants to be on these social networking sites to stay connected with "friends". Little do they realize there is a liability with them if they do something bad which leaves them exposed to the people they have wronged when they call them out.

Watched the ABC/NBC video and read the article. Interesting group of folks riding. At first I assumed it was like a criterium group or something but it appears to be just be a group of guys that like to get together and just happen to be on fixie bikes. Unfortunately for all, the riders will bear some responsbility for their negligence (bikes were not suppose to be there at all) and I would bet the driver is most likely uninsured or underinsured and has/little or no money. Oh well... the risk people take when they ride at night - all those drunk drivers out there.

I pray and hope everyone, regardless, is OK.

And the whole posting the facebook thing... grow up man. How cruel is that? It was just a dumb stupid girl doing a dumb stupid thing she will have to pay dearly for.

It was tongue in cheek, I don't mean for anyone to seriously call her unless they want to. But don't defend her by saying it's dumb and stupid as if it's just one of those things that happen to youths. This is beyond that.

From what I understand it's a public roadway-- if cars can be there legally, bikes can be there, and they were stopped at the side of the road (parking lane and sidewalk) to wait for stragglers. Nobody should have been putting a car where they were waiting, let alone at speed. If you've ever seen an MR group waiting around by the side of the road, they're hard not to notice. Blinky taillights these days are very bright, and many riders leave headlights on while they wait around, too-- LED+Li-ion batteries last a long time at high brightness.

Please don't assume I condone or offer an excuse for the women's actions. I am violently opposed to driving under the influence as well as texting and phone use during driving however, that said, you and I don't really know the facts or what happened. To even jokingly offer up her FB page or encourage people to harass her is just cruel. I hope and suspect she will get her due process and will be penalized for her actions. She doesn't need trolls and jerks harassing her.

Also to the legal issues on both sides, its up to the police investigators and the Court to decide. I admit I don't know the facts but have seen in news reports that bike riding is specifically prohibited at night in that area. CA is a comparative liability state so negligence can be assessed on both sides.

Here is the rub... she may have seriously injured a number of people but if she has no money or insurance, they can't collect. She won't be jailed... jails are overcrowded as it is and seriously violate criminals are released as it is so nothing will happen to her (OK she will lose her license if not alredy but as we know so what?).

This is where we need to get active and change laws.

In this state it was 15/30/5 which means a total of $30,000 for multiple injuries (ie more than one claimant) and $5000 total for property damage. It may have been increased recently, I don't know. Hardly enough to cover hospital and doctor bills for 11 injured riders.

And Courts seldom attached damages to future earnings... it would be up to the claimants to go after this woman after a civil trial. What attorney would handle a case against someone who has no money to collect?

I hate to say it Alice, but HA! Any financial liability for "accidental" injury or damage can be expunged in bankruptcy. The list of debtor exemptions in California is extensive. Basically, anything the court deems necessary to provide the basic necessities of life can be exempted from paying a money judgment. A judgment can be recorded with the county recorder, and remains valid for 10 years, at which time it expires unless renewed by the creditor. If the driver has complied with the financial responsibility laws of California, she carries a 15/30 public liability policy. That means $15,000 / person injured, $30,000 total for paying all monetary damages.

There is at least one, if not more, people in critical condition, that most likely means an intensive care unit. How far is $15,000 going to go for medical bills, not to mention future loss of earnings due to disability, and medical expenses for any residual condition that resulted. Unless, and until, the federal bankruptcy laws are seriously curtailed, and state debtor exemption laws are repealed to make people financially responsible for the consequences of their conduct, the idea of being adequately compensated for damages by an individual is a joke, and the basic reason an attorney looks for a deep pocket such as a large corporation or municipality to name as a party to a lawsuit for damages. In this case, it may well be Culver City for failing to adequately maintain street lighting. Of course, if the city is found responsible for damages, the city will raise the revenue to pay for the damages through increased taxes and/or fees, so the residents of the city will pay the bill instead of the primary responsible party, the driver of the car.

Not an opinion; just fact.
