Not to be overly critical of the cyclist... but was the truck not visible ahead?
I know this route well (its right around the corner from my office). It's quite easy to get going 30+MPH down this hill. I typically leave the BL as the road narrows near the bottom and there is at least one uncontrolled intersection before the light at the bottom.
I want to be visible, to have clear sight lines and have room for escapes if need be.
There are no photos in the story, but if you look at this google maps image, you can see a series of slashes along the right lane... these effectively cut off the right lane (a painted island if you will). I typically leave the BL and ride in this painted island.
For someone to crash into the back of a parked vehicle indicates to me that they were not looking ahead.

will the driver and landscaping company be culpable in the boys death, for illegal roadway use resulting in a death?

This is the real tragedy of these events... that law breakers are not cited in such situations... typically the LEOs make statements about the tragedy of the situation and how the offender won't forget the lessons of the day... meanwhile someone riding a bike is still dead...

After reading the article I can't help but remembering two phrases stated in the there"
1.) Parking in the bike lane is illegal.
2.) No citations were given.
C'mon now, at least write a ticket for illegal parking if that is the case. Why wait to do that simple of a task? If they *might* be filing other charges they can ammend, but why hesitate to write a citation for a law that was broken that either directly or indirectly caused the death of a child?

Shouldn't the police be partially responsible here too? It seems like it's a fairly common practice which the police are well aware of, and yet they've done nothing. Does someone have to die before a law is actually enforced?
Edit: were there any traffic cones this time? No mention in the article.

Then again, the other boy managed to avoid it, and the curve doesn't look all that sharp. Something doesn't add up. Any idea of the exact location of the collison?

However, that stretch of the road has a painted island just to the left of the BL and the island offers a great buffer from autos... I usually ride in that buffer at that speed rather than in the BL.

A roadside shrine – with a smiling pumpkin, teddy bear, flowers and cards – was erected at the crash site yesterday, not far from where trucks continued to park in the bike lane.

Considering that I've seen such trucks park in regular motor vehicle lanes -- also illegally -- I don't see why this should suddenly be worse.
I really want to have sympathy for the boy, but I also can't help but think that he should've been paying better attention. I know that I sound heartless, but I wasn't paying close attention when I hit a parked car, either (thankfully it just resulted in bumps & bruises and a bent wheel).
