It's very possible but regrettably it's still their call. From my experience (seeing this whole thread is going to be conjecture) a lot of claims with bike manufacturers fall on the reporting shop....

They need to honor it if the frame is eligible. In this case, apparently, Cervelo has determined the defect is not covered. I for one am curious why only 300 "biker" forums, there's gotta to be more...
