Singlespeed & Fixed Gear "I still feel that variable gears are only for people over forty-five. Isn't it better to triumph by the strength of your muscles than by the artifice of a derailer? got hit need some advice

Got hit a couple days ago: ok here's the story, I was riding northbound on clark street in chicago and hung a left to around a bus, because I obviously did not want to go in the farthest right side of the street because the bus was ready to pull in to pick up pedestrians. So I go around the bus and pass
three cars (This was around rush hour so traffic was pretty backed up at the time) and I guess one of the three cars proceed to slow down to let some one come out of a parking lot, the person coming out of the parking lot was trying to hang a left out of the parking lot to go southbound on clark.

Pretty much disrupting all traffic on the norhtbound side of the street. We'll to make a long story short I could not see the person coming out because I chose to pass the last of the three cars in the middle lane, on the dotted yellow lines the last car was a tall SUV so I the visibility I had was not very good. As soon as I pass that SUV I see a cars front end sticking out at me, I tried to stop but at this piont I was already in the air and then rolled on her hood and fell right off of the car.

As soon as I landed my adrenaline level was up, so I just got up ran for my bike and pulled over to the side walk. The lady that hit me was freaking out, asking if I was alright. I didn't know if I was alright. But I came out of the accident with like a couple bruises and scrapes but that was it no pain really, I was really lucky because I was not wearing a helmet at the time.

I refused the ambulance because there was nothing seriously wrong with me. We got a police report, the cops took like 35 to 40 minutes to come though. The lady that hit me was cool she works for an insurance company, As soon as i heard that, I was like oh great. But she asked me if was alright, I said I was fine but my bike was f**k*d though. The head tube and fork was bent slighty along with the front wheel being bent as well. she did not say much when I said thatfor obvious reasons.

She drove me home after the police report and said if I needed to go to the hospital later to give her a call. I mentioned my bike again during the accident and she still seemed to not say much. I just want my bike fixed, The Lbs is trying to bend my frame back as we speak, because it looks like a clean bend with the fork and head tube, the headset seems to turn smooth still. and the I just need a new wheel built hopefully. So my initial question for everyone hear is who is a fault? should I even bother getting a lawyer? I just want my bike fixed. Should I call the person that hit me and try to work it out with them?

What did the police report say? Usually they determine who was at fault.

yeah. I think it might be my fault too, the officer did not put who was at fault on the report, He did not really care to be there. He seemed kind of difficult to work with on both my part and the drivers.

Basically, I cut into the middle of the lane right at the last car, but visibilty was bad due to the suv. usually in this type of situation I would have saw it coming. it still baffles me to how I got hit.
If i wouldnt cut into the middle i think i might have still got hit, considering she came out rather abruptly to turn into the opposite lane
