Aluminum dropouts aren't "designed to be modified" either. I don't get your point. The finish on the fork legs is applied as a decorative finish. The steerer tube needs a more precise outer diameter and is not visible after assembly so it's left unfinished. That doesn't make it any more or less able to be modified.

I can guarantee you that as long as he does not cut into the dropout aside from in the area of the lawyer lips that the fork/dropout will not be any weaker. The warranty issue is a valid point if that's a concern.
