Well, some people argue that it is always legal. That is, it is never required to ride at the right side (which, with a FRAP law, obviously, isn't true). You haven't answered the question in any useful way. It seems odd to ask that somebody explain themselves when you don't seem able to do the same. When is it "legal to"?

What determines "breaking the law"? Put another way, how do you know whether or not you are breaking the law? To keep things simple, let's ignore people who know they are breaking the law. (I would hope that people abide by the law without needing to be forced-to!)

If it's legal to take the lane, then I'd trust the actual cyclist in the situation to make the choice for him/herself. Because a law allows something doesn't mean it's required!
