Nice summary. I doubt the State will charge him with second degree murder, particularly since he doesn't have a previous DUI, unless there's evidence of really outrageous driving or extreme blood alcohol (more than speeding,and leaving your lane.)
Good news is that they can get a substantial sentence without the the need to charge him with 2nd degree murder.
