I know this is not the place for the immigration "hot potato" that no Politician wants to face but, don't be so sure. I personally know of a couple, in their 60's, also from Venezuela that have been living in this country (on a tourist Visa) since the mid 80's. They do not have their residence "green card" and have been able to fool the authorities for over 25 years by going out of the country to stamp their passport before their I-94 expires.

As to this guy, if he is here on a special visa like an O-1 (common visa for entertainers) he will be deported after serving if he gets convicted and does time (hopefully).
