That may be the whole thing this issue hinges on. Personally I'd like to hear both sides of the story. To play the devils advocate, I can see the police getting perturbed for taking the lane when the shoulder looks like it does in the pictures. Couple that with not knowing if we're dealing with a rider that wants to push the issue, and like I said, I'd like/prefer actually to hear both sides.
