Well, seeing that the impact occurred off a roadway by a vehicle meant to travel on a roadway, I would say it is more a public risk than simply a cycling risk and the public should be able to do something about wayward driving rather than accept it.

If your point is, stuff happens, I would say, just what is the likeyhood of stuff happening? Rare and unpredictable events happen all the time. Do we gear up for all unlikely occurrences? Not really, but some people think cyclists should. Often with ineffective equipment that was never meant for the rarities that some people fear.
