It seems weird that there is disincentive to clear the snow from the sidewalks. Wouldn't people be just as likely to sue if they twisted an ankle or something in the snow?
I was on crutches for a week one winter when we lived in the city. I had very mean thoughts about people who didn't clear their walks.
The version I heard is that an uncleared sidewalk presents an obvious hazard, while clearing off the snow means that there is no longer an obvious hazard.
