OK, OK, yes, there are certainly good points made by all here regarding instances where the courts in the US and Canada have been less than fair and sometimes absolutely unreasonable (if you read my previous posts, I do not say that the courts are right all the time). I am aware of these other incidents and agree with everyone's comments. However, there are some obvious differences between the cases cited and the Brazilian incident. Most notably, the driver in Brazil deliberately plowed down cyclists - in most (not all) of the cases that everyone has cited, the evidence of wrongdoing was not nearly cut and dry as the video evidence of the Brazilian which clearly shows the callous intent of the driver. AND it WAS all caught on video - how many videos exist for the other instances that are mentioned in this discussion?
