40 kmph tailwind means that if you are going less than 40kmph you don't need to draft. Of course with a 40 kmph tail wind you can probably ride faster than 40kmph on the flats pretty easily. Also it will rarely be perfectly behind you. If it's off angle a bit you will lose some of that tailwind.
