Windspeeds are not generally measured at bike riders height. So a 40kmh tailwind might be closer to 30 or 20 down on the ground.

The only time you wouldn't benefit from drafting would be if all your power was used up overcoming rolling resistance. It's not going to happen in a bike race unless maybe you're riding in a hurricane or doing a crit in the middle of a tornado (in the appropriate direction).
