I can't comment if there is anything to worry about but I would guess that the stays were/are bent. This is not a huge problem and you can learn how to fix them if you wish.

As for the crappy packing job, be sure to mention that in your feedback report and any other concerns that you have. Sounds to me, and looks to me, like the seller did a poor job with just about everything.

Contact the seller, and if the condition, as arrived, is significantly less than advertised, I would attempt to send the bike back or seek some form of reimbursement.

You cannot go after the shipping company. Only the sender can do that so you will still have to deal with the seller. Bummer, I know, but that is the way it is.
