There's likely more to that story -- he was drunk or speeding (even beyond the "too fast for conditions" thing), etc.

We do not typically send drivers to jail simply for making mistakes that anybody could make. They have to do something more -- being drunk, evading police, extreme (not just a little) speeding, texting as a reason is up and coming, etc.
