That's because the health insurer has no stake in it. You have limits, they have limits. Your medical on your auto insurance covers your medical fees, your full coverage does your damage fees, and your UM covers anything not paid. If the motorist doesn't pay, you go to your insurance company and say, "He won't pay up. You pay up." Then they go, "What? That's not happening." Then they sue the guy's insurance company.
Health insurance pays some amount, end of story. Your surgery is a $5000 operation; your insurer agrees to pay $2200 for the operation, $1700 of which will be paid by the insurance company and $500 of which will be paid by the client's deductible. The guy that hits you is liable for paying your deductible. Won't pay? Your problem.
