IIUC... there are some states where the injured party will collect nothing if they are even 1% at fault, and in such states, it is a mistrial if the injured party's lawyer mentions that to a jury.

of course that is in regards to collecting from another party's motor vehicle insurance. collecting against ones own medical insurance generally pays even in cases of extreme stupidity, regardless of fault.
