I think I'm with BT on this point. What if a kid ran from the side walk into that (probable) blindspot and got killed? It'd be tragic and sad, but I wouldn't hold the driver accountable.

I don't think without a firsthand account of what happened we can say that the driver is negligent. If there was a bike lane or the truck was entering the cyclists lane then that would be one thing. But if the rider rode into a pinchpoint, a well known blind spot, I'm not sure that we can place a majority of responsibility on the driver.

BTW, I'm not pro driver. A few years aog here in Portland, an aquaitance of mine was killed by a truck at an intersection. Matt had right of way, the driver had a stop sign. The driver either didn't stop or he didn't look. This seems to me to be an obvious case of depraved indifference. I think the driver got a ticket for unsafe driving, $40 I believe. Thats a pretty clear case.

Lets all try to ride a little safer today.
