If a business sells something, it has the responsibility to be aware of it's condition. That is why we go to proper businesses, sometimes, instead of individuals. The business, by nature, and law, has a responsiblity to sell functional, safe products.
If I went into business selling used bicycle parts, I would make sure I knew the condition of every single part.
It is hard for me to believe that it would ever be otherwise.
