I'd pursue the situation to protect someone else. I'm not that big on suing 'just because'. It was off the white line and it could turn out you damaged the line and become liable yourself. I like to try to protect the next person and not 'make someone pay'. We have too much of that already.

Also you have this: We are vehicles on roadways. There are laws that state you must allow distance between the vehicle in front of you and we are all guilty of breaking that law. Might bring you a ticket to fight it.
