This is no different than shooting to a barking dog in its own yard behind the fences. He could've argued that it looked like the dog *might* have jumped over the fences. In case it was both chained and behind a fence, well it's no show stopper either: It might have looked like it was going to break its chains and then jump over the fences...
Shooting a dog in its own yard would be a criminal offense here in Turkey. One exception being if the dog has already attacked people enough to be condemned to euthanasia by animal control, and its owner is not cooperating, then animal control would pay a visit to the dog in its own yard and shoot it down there, no matter if it's chained or behind a fence.
