Since you're not actually using a Brooks saddle, it's misleading at best. If you were sued (which Brooks probably won't waste legal fees over), you could not defend yourself with the defense that what you said was true.

FWIW, I have some blue and green shorts, in addition to black, and I've had zero stain problems on those from my Brooks saddles (it's the truth, your honor!).
