I would say yes. I am not where I am supposed to be. If there is no bike lane, then I am entitled to the right lane and therefore it's OK for me to be in the road.

If the bike lane has any signage that says it's OK for joggers/runners, then that's OK too. But I've never seen one where I live/ride.
