I had the same thing happen years ago with a set of composite MTB Time pedals. I sent them and back and the new ones where the same. I've been riding on them for over 10 years and they never loosened up any more; I'm guessing some designs just have a little play.
This is pretty much what the Crank Brothers guy told me. Thanks for the reassurance! I'm kind of OCD when it comes to bikes. You should see me when I install fenders...adjust...tweak...a week later...adjust....tweak...
