In MN the "I didn't see him" argument is an automatic admission of guilt of improper care when operating a motor vehicle unless there are mitigating circumstances such as a blocked view or illegal/improper action by the rider/pedestrian. You can fight it but once you say "I didn't see him" the burden is on you to prove why a reasonable person would not have seen the victim under the same circumstances.
I have no idea what happened in this case but my heart goes out to the family and friends of the boy and to the driver of the vehicle if indeed it turns out it wasn't his fault. Just as I can't imagine the grief of losing a child, I can't imagine the horror of being involved in the accidental death of one.
Unfortunately that's not a universal approach to the problem. There was another story recently in which the driver wasn't charged because "Who hasn't accidentally swerved on to the shoulder"? As if that's a valid reason.
