Actually, it's not illegal to pass on the surcharge, but it used to be in the vendor agreement that you couldn't offer different prices for credit vs cash. However, that's about to end. In the recent lawsuit that was brought against CC vendors, one of the conditions of the settlement was that swipe fee's and vendor fee's could be added on to the cost of the goods...basically passing it on to the consumer. I'm not sure when this is to go into effect (I wanna say April, but not sure at all) but it's coming. What's to be seen is if the stores actually implement this.
