Absolutely. In most states in the U.S. it would be a low level of sexual asault, typically a misdemeanor.
However, is it possible Sagan has a relationship with the woman? The riders aren't supposed to fraternize with the podium women, but it happens.
If she was Sagan's girlfriend, their could be some implied consent that could take the conduct from criminal to just boorish.
