While it may not be legal it's also likely there will be no consequences for the motorist, so if you want to keep moving it's more or less like any motorist pulled over by a LEO or like a couple motorists who collided and have pulled over to the curb to exchange contact info or to wait for assistance. Since you probably observed them from a minute away, merge into the next lane or the line of traffic going around them and keep moving.
He's either kidding (or insane). For either case, it's probably best just to ignore him.
