I honestly would not and I don't think it's because I have low expectations. Maybe it's just the poor photography, but I can hardly see any scuffs and I just can't see how anyone can reasonably be bothered by them. I've never seen a Brooks outside of box that didn't have a scratch on it. It's what they do; they get ridden and scratched.
So when you go to the grocery store to buy produce do you just grab the first tomato you see regardless of possible imperfections?
