Exactly, I have to travel down a very similar type road.
If the judge's ruling said, " unless safety issues dictate otherwise." then riding in the right hand lane, away from the curb to discourage close passes would apply.
There's no 8' shoulder that I see (if the link above is the roadway), no shoulder at all. You're either in the road or on the sidewalk.
Is there any restriction on using the sidewalk?
Again, if that's the roadway in question, in the link, then I'm taking the lane. There's not a FRAP option in that road even hugging the white line, you're in the lane/road.
