The MA law says:
"the driver of a vehicle when about to be overtaken and passed by another vehicle approaching from the rear shall give way to the right when practicable in favor of the overtaking vehicle"

The judge interpreted the laws correctly by defining the cyclist as the driver of a vehicle. He needs to move over to the right when practicable when being passed. This says absolutely nothing about leaving the roadway.
