As for how it would go in court if fought, I don't know. I'm somewhat sceptical that a court would see it as Forrester said, but maybe. I'm guessing that he's technically correct, but lower level courts often don't care for technical arguments.
Technical arguments? If the law applies only to motor vehicles, and some LEO misapplies it to bicycles, the dismissal is almost automatic once it reaches a judge. But some states proliferate traffic administrators instead of judges, so for legal sense one has to reach the judge level.
