If there is a fundamental flaw in the vehicle, you bet there is a legal liability to the manufacturer and dealer. There have been umpteen thousands of vehicles recalled in the US and elsewhere for design and manufacturing errors that have resulted in, or could result, in death or injury, irrespective of how good or bad the drivers may be.
