Has to be a trick of the light. The crank arm has to rotate freely against the spindle so the flat spot on the cotter can properly engage the flat spot on the spindle. Putting a woodruff key on the spindle would totally defeat that. And it's not symmetrically placed.

The crank in the picture is not a high end crank. Really nice cottered cranks are... well, really nice!
