I thought one of the better comments was this:
I think you are missing the point of the AD. Both parties were at fault. You could actually debate that due to the speeding driver, the other driver who thought he had enough time actually didn't because of the other driver's closing rate.
The moral here is both are making a mistake. Stretch that a bit further... We've all gotten enraged over someone else's mistake in pulling out in front of us, etc. We've all made that same mistake. Many traffic near misses are common and everyone makes them. As careful a driver I think I am, I always give someone the benefit of the doubt before losing my cool unless they are just being plain wreckless which becomes apparent in short order.
