No and No to both questions
Warranty is in place for manufacturer defects. If they went out and fixed everyones bent frame due to crashes they would be out of business...
Also, they only warrant the original owner because they don't know what happened in the exchange of hands.(Actually I don't understand this part of it but thats Ok, the answer is still no)
